For many new condominium associations, the prompt and
effective resolution of construction defect issues and
disputes with the condominium’s developer is of key
importance. The failure to quickly identify and raise
construction defect claims can be disastrous for an
association, as the ”ticking” of the statute of
limitations “clock” begins in earnest in most cases once
the developer has turned over control of the community
to its owners. A board’s failure to timely address such
issues with effective legal counsel can result in the
association bearing thousands (or perhaps hundreds of
thousands) of dollars in additional repair costs and
expenses that could (and should) have been borne by the
developer.
Our
